By service

You hire parts of the project at an agreed price. You keep 100% of the land and of the sales.

Management

You finance. We direct the paperwork, works and control for a fee agreed in writing.

Partnership

You contribute the land and we contribute the design and its execution. The sharing of results is defined in a contract, and it is wise to review it with your lawyer.

WHAT THE OWNER MUST CONTROL

Points of the law that cannot be delegated

  • Clean title. A subdivision is not approved with an attachment or litigation, and if there is a mortgage the creditor's consent is required (art. 241 of Law 3966/10).
  • Registration before selling. Lots cannot be sold without registering the final approval resolution (art. 246 f).
  • Installment sales. The resolution must be registered as a marginal note and the standard contract with the Public Registries (art. 250). Once the contracts are registered, the property is unavailable: it cannot be sold, leased or encumbered (art. 253).
  • Buyer's rights. The buyer can demand the deed upon paying 25% of the price (art. 255).

We explain each point and comply with it on your behalf, but legal responsibility lies with the owner. A review with your lawyer before signing is good practice.

How it is charged

The charging method depends on the model you choose and is agreed in writing before starting. We do not publish general percentages or fees because they change with the size of the project and with what you want to delegate. Ask us for a proposal for your case.

Before delegating the management

What does project management include?

Handling the paperwork with the municipality, MADES, the RUN and the utilities; directing and controlling the power, paving and water works; cost and deadline control; and progress reports to the owner.

How is the management fee charged?

It is agreed in writing before starting, depending on the chosen model: price per service, management fee or partnership. There is no single percentage, because it depends on size and scope.

Who answers to the municipality?

The law places the obligations of art. 246 on the owner. We carry them out and control them on your behalf, and you sign what is required.

What about installment sales of the lots?

The law requires registering the approval resolution and the standard contract with the Public Registries and each contract with the municipal cadastre (art. 250). We can guide you on the documentation, and we recommend that your lawyer review the contract.

What taxes are withheld if a company sells my lots?

Under SET General Resolution 35/2020, a resident individual is withheld 8% on 30% of each installment collected, an effective 2.4%, as a single and final payment. Resident companies have a 2.4% withholding on account of the IRE. Check with your accountant whether that rule is still in force and how it applies to your case.

Can I see how the project is progressing?

Yes. You receive progress reports with the paperwork filed, the works carried out and the expenses.
